Uncontested Divorce In an uncontested divorce, the divorcing couple agrees on all the major issues, and enters into a divorce decree voluntarily. If the parties can agree to the terms of divorce, they will save a considerable amount of time and money. Mr. Alvarez recognizes the value in such an agreement, and will recommend that you enter into an uncontested divorce agreement if doing so would be in your best interest. Contested Divorce A contested divorce occurs when the two parties cannot agree on the terms of their divorce and they have to get a court decide the terms for them. In contested divorces, often the primary issues of contention concern property division and child support. Texas is a community property state. Under a community property system, the state divides all property acquired during the marriage equally - even if the property is held in only one spouse's name. In a community property state, there's a presumption in favor of distributing equal shares of marital property to each former spouse. However, property acquired prior to the marriage - and in some jurisdictions, gifts and inheritance received by one spouse as well - stays the property of the individual spouse who received it. Other issues that are often contested involve child custody and the support that the custodial parent receives.
